Terms & Conditions

Undertaking:

Mosaic Tourism undertakes to provide all tours and/or services offered subject to the terms and conditions set out herein. All terms and conditions will be accepted by the client upon confirmation of any booking.

Mosaic Tourism guarantees all reservations for scheduled day tours provided that it is requested twenty four (24) hours prior to departure.

In order to ensure availability of preferred accommodation establishments on escorted overland tours, it is always recommended that reservations are made at least 30 days prior to departure date and that any special requirements and/or preferences are communicated up front.

Mosaic Tourism makes every effort to ensure that the various services making up your tour will be carried out efficiently and as specified.

Our drivers and tour guides are trained and possess the necessary qualifications and documents.

Definitions:

Mosaic Tourism refers to Mosaic Tourism cc, a closed corporation business entity, established in 2011, incorporated at the Registrar of Companies, Registration Number CK 2011/084334/23

Client means individuals; groups, companies or other legal persons using the services offered by Mosaic Tourism and includes the agents of clients.

Tour means the provision of services/activities and/or accommodation and/or transportation and/or meals as offered by Mosaic Tourism and accepted by the Client.

Booking means the confirmation of the selected tour enquiry and/or quotation and thereto acceptance of the terms & conditions of Mosaic Tourism, by the client.

Check In / Departure means the scheduled date and time of departure of the vehicle used for the tour booked, whether it is a Mosaic Tourism vehicle / outsourced vehicle.

Prices:

Prices are subject to change without prior notification. Prices are also subject to adjustment in the event of changes in government imposed taxes, fuel price, hotel charges, tourism levies and or the introduction of national, regional or local taxes or levies of whatever nature.

All prices and rates are quoted in ZA Rand, unless otherwise specified. Payment in approved foreign currency will be accepted at the rate of exchange applied by the bankers of Mosaic Tourism at the time of receipt of payment. Any shortfall resulting from exchange rate fluctuations will be for the account of the client.

All payments made for booked tours are final and any reimbursements and /or refunds are subject to the Terms and Conditions herein.

 

Tour Price Exclusions:

The tour price excludes: Any tips and gratuities (left to the individual’s discretion); personal items (beverages, cigarettes, telephone calls, room service, laundry and other extras); air and rail fares (unless specified as part of a package); visas, health requirements, immigration requirements. Mosaic Tourism accepts no responsibility if such documentation is not in order – visitors should consult their travel agents.

 

Child policy:

Children of all ages are welcome on our scheduled day tours, with exception certain Safari Game Drives, where certain of the Game Reserves terms and conditions prohibit children.

Bookings on our escorted overland tours are strictly subject to the availability of child-friendly accommodation at the time of request.

All children under 12 years of age must be accompanied by at least one adult for any day tour.

Child Discounts:
Children under 12 years qualify for a discount on certain tours when accompanied by two full paying adults, subject to confirmation upon booking.

Children under 12 years, qualify for discount for certain accommodation, provided they are accompanied by and share the same room with two full paying adults. Restrictions apply to certain tours and are subject to the terms and conditions of the accommodation vendor secured, subject to confirmation upon booking.

 

Payment:

Fifty percent (50%) of any tour is due and payable on booking the tour. Full & Final payment is due and payable 30 days before tour date departure. Bookings made within 30 days of departure must be accompanied by full payment.

Payments can be made via direct EFT Bank Transfer, Paypal or via Credit Card using our on line facility Pay Bridge. (Visa, MasterCard accepted).

 

Cancellations:

All cancellations shall only be valid if received by Mosaic Tourism in writing and shall be effective upon acknowledgement of receipt by the company.

The date on which the cancellation request is received by the company relative to the date of the booked tour will determine the cancellation charge, if any, to be levied.

Cancellation charges expressed as a percentage of the Total Tour Cost are as follows:

  1. Cancellations received within 60 days or the tour date: 25% forfeit fee
  2. Cancellations received within 30 days or the tour date: 50% forfeit fee
  3. Cancellations received within 15 days or the tour date: 75% forfeit fee
  4. Cancellations received within 10 days or the tour date: 100% forfeit fee

Cancellation Forfeit Charge exceptions exist:

  1. Only for inbound Cruise Ships / Inbound Air Flights, where the Cruise liner / Airplane could not make terminal / dock arrival due to unforeseen weather/circumstances. In this instance, the tour will be rescheduled and accommodated if possible by the company.
  2. In instances where the Cruise liner / Airplane cannot/will not land /dock at all, the tour is cancelled and a minimum late cancellation fee of 20% of the total rate is charged. [80% refund on total tour cost is given]
  3. If the Cruise liner docks and for any reason the Captain or Cruise Company decides to not disembark, a cancellation charge of 30% of the total cost will be imposed. [70% refund on total tour cost is given]
  4. A full refund, relative to retrievable tour costs, will be considered on merit by Mosaic Tourism Management, in the event of illness / hospitalisation / accident or death, upon receipt of proof.
  5. No refunds will be given for no-shows, or any unused services irrespective of whether they form part of the basic tour price, or whether they are in respect of pre-booked optional arrangements.
  6. Alterations:
  7. ‘Force Majeure’ means, in relation to the Company, any circumstances beyond the reasonable control of Mosaic Tourism (including but not limited to, acts of God, explosion, floods, fire, war or threat of war, sabotage, civil disturbance, quarantine, government intervention, weather conditions or other unexpected occurrences).
  8. Mosaic Tourism shall not be deemed to be in breach of these terms and conditions or otherwise be liable to the Client, by reason of delay in performance, or by non-performance, of any of its obligations to the extent that any such delay in performance of non-performance is due to Force Majeure.

If Mosaic Tourism is affected by Force Majeure it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the tour booked.

  1. No refunds are given for circumstances arising beyond the Company’s control, necessitating alternative arrangements being made to ensure the safety and/or further participation and enjoyment of the tour.
  2. In the unlikely event of a vehicle breakdown that is beyond Mosaic Tourisms’ control and immediate repair, the Company will arrange for the spare part to be sent to the current location in the fastest possible time. Mosaic Tourism reserves the right to alter the itinerary accordingly in order to make up any time lost due to any unforeseen circumstances.
  3. The Mosaic Tourism reserves the right to cancel the tour without prior notification and in such an event only agrees to refund all monies already paid and received from the Client.

Mosaic Tourism shall not be held responsible for any damages and/or losses whatsoever incurred by the client as a result of cancellations / alterations levied by service providers over which we have no direct control.

The Client will be notified immediately of any cancellations within the itinerary and/or any changes that are made

 

Accommodation:

Accommodation is as specified in the itinerary or brochure and is based on 2 people sharing a room [either two single beds / a single double bed]. Single rooms are available at an additional cost but cannot be guaranteed. The use of specific accommodation is subject to availability.

Mosaic Tourism reserves the right to substitute hotels with other of a similar or higher category at no additional cost to the traveller, even after commencement of the tour.

 

Meals:

Meals included are as specified in the tour itinerary. Please check the applicable itinerary for details. Mosaic Tourism will not be held responsible for ensuring all dietary needs are catered for.

If advised in advance, the dietary requirements will be forwarded to the booked catering and/or accommodation venue to ensure, where possible, that dietary needs are considered. Mosaic Tourism will not be held responsible for any meal malfunctions or poor services rendered by service providers and/or booked establishments.

 

Transportation:

Transportation is in air-conditioned Land Rover, Sedans, Minivans, Minibuses or busses appropriate to the requirements of the tour and based on client numbers. Mosaic Tourism reserves the right to sub-contract vehicles. All sub-contracted transportation companies are trained and possess the necessary qualifications and documents.

 

Health & Visas:

It is the responsibility of the agent and/clients to ensure that all the necessary documentation, health insurance and/or precautionary medication measures are attended to prior to travel. Mosaic Tourism does not accept responsibility in this regard.

 

Luggage:

1 Suitcase and 1 overnight bag (hand luggage) per person allowed for overland tours. Mosaic Tourism accepts no responsibility for loss or damage to luggage or personal property from whatsoever causes arising. Clients are advised to take up adequate insurance cover.

 

Right of Admission Reserved:

Mosaic Tourism shall at its discretion enforce conduct rules, and reserves the right to decline to accept or retain any person as a client. Clients shall obey every lawful instruction of any employee of Mosaic Tourism.

 

Smoking:

Smoking is not permitted on board vehicles and in accommodation/ restaurants. Comfort stops will be made en route and designated smoking areas are to be used by clients.

Check in /Departure Time:

Clients shall check in at all departure points at least 30 minutes before the scheduled departure time. Mosaic Tourism does not accept responsibility for any client who fails to comply with this condition.

 

Delays:

Mosaic Tourism shall not be responsible for the consequences of any delays whether arising from accidents, breakdowns or any other cause.

 

Responsibility:

Mosaic Tourism does not have control over the provision of services by any accommodation and/or transport (cruise liners, airlines, trains, busses etc) vendors and shall not be liable for any loss, damage, injury, additional cost, accident, delay or irregularity that may be occasioned by any error or default.

 

Standard & Safety:

Mosaic Tourism undertakes that all of its own fleet vehicles:

  • Are large enough to accommodate the number of clients and luggage.
  • All drivers are licensed in terms of local legislation.
  • All vehicles are safe and comply with relevant safety regulations.

 

Insurance:

All travellers are advised to and are solely responsible to take out comprehensive travel insurance and to familiarise themselves with any exceptions and conditions as may be imposed by the insurance company or underwriters issuing the policy of insurance which they select.

Mosaic Tourism holds Client Liability Insurance and Public Liability Insurance underwritten by HIC Insurance.

 

Law:

The law of the Republic of South Africa shall govern the relationship between Mosaic Tourism and the client and the Courts of the Republic of South Africa shall have sole jurisdiction in respect of any claims and/or disputes which may arise between Mosaic Tourism and the client, or Agent.

 

Disclaimer:

Mosaic Tourism, their employees, agents and associates shall not be responsible for and shall be exempt from any liability in respect of any loss, damage, injury, accident, delay or inconvenience to any person or their luggage or other personal property whether the same shall occur and whether the same shall arise from or be occasioned by the negligence of Mosaic Tourism, their employees, agents, associates and other persons indirectly in the employ or service of Mosaic Tourism or otherwise under any circumstances whatsoever.

 

Cancellations:
